Hormone Therapy Alone Sufficient For Legal Change of Sex

A trans* woman has won the right to be recognised as a female after her original application for a gender reassignment certificate (based on hormone therapy alone) was initially refused by the Gender Reassignment Board of Western Australia (GRBWA).

The certificate, which provides protection from discrimination under the ‘gender history’ provisions of the Equal Opportunity Act, was granted by the State Administrative Tribunal (SAT) after the decision was appealed by the applicant. They cited the recent High Court decision that hormone therapy alone can be considered a reassignment procedure, and SAT ordered the decision of the GRBWA be set aside.

WA Gender Project spokesperson, Aram Hosie, welcomed the SAT’s decision commenting, ‘this case together with the recent High Court decision, has clearly established that surgery is not required for a legal change of sex for both trans men and trans women.’
